Access to Justice and the Right to Care

This report traces the regional process that led to the recognition of care as an autonomous human right and analyzes the standards established by the Inter-American Court of Human Rights in Advisory Opinion 31/25. Within this framework, it examines the link between the right to care and access to justice, with a particular focus on the barriers that hinder its effective exercise and on the role of the judiciary and public policies. Finally, it proposes a roadmap from Latin America to advance its implementation and enforceability.
